Viridian Reclaims Marketplace: Terms of Use
Last updated: November 6, 2026
1. About these terms
These terms of use apply to everyone who uses the Viridian Reclaims Marketplace at marketplace.viridianbuilds.com (the "Marketplace"). The Marketplace is operated by Studio Viridian / Viridian Builds ("Viridian," "we," "us").
By using the Marketplace, you agree to these terms. Before you create a seller account or submit a listing, you will be asked to confirm that you agree to these terms by checking a box. If you list an item, you also agree to section 7. If you do not agree, please do not use the Marketplace.
2. What the Marketplace is
The Marketplace helps people find reclaimed and salvaged building materials. It brings together:
- Listings from independent reuse stores. We read the listings these stores publish on their own websites and show them in one search. Each listing links to the store's own page. The stores are named on the Marketplace.
- Links to other marketplaces, such as eBay, Craigslist, Facebook Marketplace and OfferUp. Depending on the source, the Marketplace may display limited information or direct you to that site. Purchases and transactions on those sites are governed by their own terms.
- Listings posted directly by sellers authorized to use the Marketplace, including Viridian when it offers its own materials.
- Viridian's own information, such as material categories, carbon estimates, match scores and distances.
3. Viridian is not a party to any sale
The Marketplace connects buyers and sellers. Unless Viridian is itself the seller of a Viridian listing:
- We do not own, inspect, store, sell, deliver or guarantee any item shown on the Marketplace.
- We do not take part in the sale. Any agreement to buy is between you and the seller, and title passes directly from the seller to the buyer.
- We do not handle payments. You pay the seller directly, on terms you agree with the seller.
- We are not responsible for a seller's description, pricing, availability, honesty or conduct, or for a buyer's.
When Viridian itself sells an item, it acts as the seller and is responsible for its own transaction obligations under applicable law. Any additional sale-specific terms will be provided with that transaction.
4. Information shown on the Marketplace
Sellers' information. Prices, quantities, sizes, condition, availability, photos and locations are shown as the seller published them. Where a seller does not publish something, we show it as not stated; we do not fill it in. Sellers' information can be out of date: items sell and prices change. Always confirm with the seller before you buy or travel.
Viridian's information. Material categories, carbon figures, match scores, distances, inspection findings, comparison prices and similar information, if shown, are identified separately from seller-provided facts. Calculated figures are estimates based on stated sources and methods. They are not measurements or certifications of an individual item unless expressly identified as such. Category-average carbon figures are not product-specific values. A third-party inspection or grade applies only to the item and scope stated in its supporting documentation. A listing is not a certification or code approval.
Not professional advice. Nothing on the Marketplace is engineering, architectural, environmental, legal or tax advice. Reclaimed material used for a structural purpose should be graded by a qualified grading agency and approved by a licensed engineer. Material used for any purpose should meet the building codes that apply to your project.
5. Lead paint, asbestos and other hazards
Reclaimed materials may contain lead, asbestos or other hazardous substances, including substances that are not visible or disclosed in a listing.
Before handling, altering or installing reclaimed material, determine whether testing or special precautions are required and comply with applicable safety, environmental and building laws. Neither publication of a listing nor Marketplace screening is a representation that material is safe or code-compliant.
6. eBay, independent stores and other sites
Independent stores sell on their own terms, from their own premises and websites. Their listings appear here with attribution. Showing them does not mean a store endorses Viridian or has any agreement with us. A store that would prefer its listings not appear on the Marketplace can contact us (section 20) to request removal. The Marketplace may retain and display resized copies of publicly available store product photographs as thumbnails. Such display does not imply that Viridian owns the photographs or has received a license from the store; copyright and other rights remain with their respective owners. Rights holders may contact us under section 11.
The Marketplace also includes an eBay section. eBay listings, search results or links may be displayed using available eBay services; availability, prices and listing details must be confirmed on eBay. Viridian is not the seller of those items and is not affiliated with or endorsed by eBay. eBay purchases and activity are subject to eBay’s own terms and policies. Other external sites reached through the Marketplace are likewise governed by their own terms and privacy policies. We are not responsible for those sites.
7. Listing on the Marketplace
7.1 Who may list
Listing is by invitation. Sellers must be at least 18, authorized to offer the material, located within the service area currently identified by Viridian, and must accept these terms when submitting a listing. Sellers acting for a business must have authority to do so and are responsible for activity through their accounts.
7.2 What you promise when you list
For every listing, you promise that:
- You own the item, or have the owner's permission to sell it, and selling it does not break any law or agreement.
- Your description, photos, condition, quantity and price are accurate and not misleading, and you will correct or remove the listing promptly if anything changes.
- Your answers to the lead paint questions are true to the best of your knowledge.
- The item is not on the list of prohibited items in section 7.3.
- If you removed the item from a building, the removal followed the laws that apply, including asbestos survey requirements and lead-safe work rules for painted material from buildings built before 1978.
- Your photos show the material, not people, and you have the right to use them.
7.3 Prohibited items
You may not list:
- Material known or reasonably suspected to contain asbestos, including material awaiting assessment. Viridian does not accept asbestos-related listings even if a seller claims the material has been cleared for a particular use.
- Pipe, pipe fittings, plumbing fittings, fixtures, faucets, valves or solder that are not "lead free" under the federal Safe Drinking Water Act, unless the listing clearly states "Not for drinking water use" and the item is offered only for non-drinking-water or decorative use.
- Devices containing mercury, such as old thermostats and switches, and fluorescent tubes and compact fluorescent lamps.
- Light ballasts or other equipment that may contain polychlorinated biphenyls, such as older fluorescent fixtures.
- Railroad ties, utility poles and other wood treated with creosote or pentachlorophenol, and any material you know to be contaminated.
- Painted cribs, children's furniture or toys.
- Products that have been recalled.
- Anything stolen, or that you do not have the right to sell.
- Hazardous waste, and anything else whose sale is against the law.
- Items that are not building materials, fixtures or related salvage, unless Viridian agrees.
7.4 Review, removal and ending listings
Viridian may screen submitted listings for completeness, policy compliance or apparent issues before publication, but does not promise to review or publish a listing within any particular time. Screening is not a physical inspection, hazardous-material test, authentication, grading, code-compliance review or endorsement. We may approve, request changes to or decline any listing.
We may edit how a listing is categorized or displayed, add our own estimates (section 4), or remove any listing at any time, including after a report from another user.
A listing ends when you mark it sold or remove it, or 90 days after it was posted or last renewed. We will try to email you before a listing ends so you can renew it for another 90 days, but a listing still ends if a reminder is not sent or received.
We may suspend or end your ability to list if you break these terms, or for any other reason, by notice to you.
7.5 Permission to show your listing
You keep ownership of your listing text and photos. You grant Viridian a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, adapt for display, distribute and display that content in connection with operating and promoting the Marketplace while the listing is active and for a reasonable archival, legal or operational period afterward. You promise that you have the rights needed to grant this license.
Photos can carry hidden information, such as the location where they were taken. Please remove location information from your photos before uploading them. Viridian does not promise to remove it for you.
7.6 Fees
Listing is free. If we ever introduce fees, we will tell you before they apply, and they will not apply to listings already live.
7.7 Your sales are your responsibility
You are responsible for your dealings with buyers, including the price, payment, taxes, pickup, safety on your premises, and any promises you make. Viridian does not collect or pay taxes on your sales.
8. Buying, and contacting sellers
The Marketplace may provide ways to contact sellers. Any communication or purchase arrangements are between buyer and seller, except when Viridian is itself the seller. Do not use Marketplace communications for harassment, spam, fraud or unlawful activity.
Protect yourself. See the item before you pay. Be cautious of anyone who asks for payment in advance, by wire transfer or gift card, or offers to overpay. Meet in a safe place, and bring help for heavy items.
Disputes between users. Buyers and sellers are responsible for resolving disputes arising from their dealings. To the extent permitted by law, you release Viridian from claims arising solely from disputes with another Marketplace user, except claims based on Viridian's own conduct or legal obligations.
You are responsible for transporting, storing and using what you buy safely.
9. Buying from Viridian
When Viridian offers its own materials for sale, the listing and any transaction-specific terms provided at the time of sale govern payment, collection, returns and other sale details, subject to applicable law. Third-party transaction disclaimers do not excuse Viridian from its obligations as the seller.
10. Using the Marketplace properly
You agree not to:
- Use the Marketplace for anything unlawful, or to mislead anyone.
- Post false, misleading or offensive content, or false reports.
- Interfere with the Marketplace, try to get around its security or limits, or try to reach information that is not meant for you.
- Use automated tools to send messages, create listings or load the Marketplace in a way that burdens it.
- Pretend to be someone else, or to be connected with Viridian when you are not.
The Marketplace is not directed to children under 13.
We may suspend or block anyone's access to the Marketplace, or any part of it, if we reasonably believe they have broken these terms or are putting other users or the Marketplace at risk.
11. Reporting a problem
Where available, use the listing report function, or email kcash@studioviridian.com, to report unsafe, misleading or potentially infringing content. Include the listing address and a description of the concern.
Copyright complaints. Send copyright notices to Studio Viridian / Viridian Builds at 2556 12th Avenue West, Seattle, WA 98119, or kcash@studioviridian.com. A notice must identify the copyrighted work, the allegedly infringing material and where it appears, and your contact information, and must include a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your information is accurate and that you are authorized to act for the owner, and your physical or electronic signature. If we remove your content after a notice, you may send a counter-notice to the same contact. We may end the accounts of users who repeatedly infringe. Viridian may remove content while reviewing a complaint.
12. Privacy
Viridian may collect and use information needed to operate the Marketplace, manage listings, facilitate contact, maintain security and meet legal obligations. Additional details about collection, service providers, retention and individual rights will be set out in a separate Privacy Notice. Do not submit information you are not authorized to share.
Who we share it with.
- The public. Listing content is shown publicly. Your general area may be shown; your exact address is not, unless you include it.
- Service providers that host the Marketplace, deliver email and provide analytics or security for us, who may use the information only to provide those services.
- Legal and safety reasons, when required by law or reasonably needed to protect people, property or the Marketplace.
- A successor, if the Marketplace is transferred to another operator (section 19).
13. Viridian's content
The Marketplace's design, software, text, categories, carbon estimates and methods, match scores and other content created by Viridian, and the Viridian names and logos, belong to Viridian or its licensors. You may use them only to use the Marketplace for its intended purpose. If you send us suggestions or feedback, we may use them without obligation to you.
14. No warranty
THE MARKETPLACE AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT THE LAW ALLOWS, VIRIDIAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, ABOUT THE MARKETPLACE, THE LISTINGS, THE ITEMS, THE SELLERS AND VIRIDIAN'S ESTIMATES, INCLUDING ANY PROMISE THAT THEY ARE ACCURATE, COMPLETE, SAFE OR AVAILABLE WITHOUT INTERRUPTION.
For items Viridian sells directly, applicable sale-specific terms and non-waivable consumer protections also apply.
15. Limit on Viridian's liability
TO THE EXTENT THE LAW ALLOWS:
- VIRIDIAN IS NOT LIABLE FOR ANY LOSS ARISING FROM A SALE BETWEEN OTHER PEOPLE, AN ITEM SOLD BY SOMEONE OTHER THAN VIRIDIAN, A SELLER, A BUYER, A LISTING, ANOTHER WEBSITE, OR YOUR USE OF ANY MATERIAL, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS, OR LOSS OF PROFIT, DATA OR OPPORTUNITY.
- VIRIDIAN'S TOTAL LIABILITY FOR ANY CLAIM CONNECTED WITH THE MARKETPLACE IS LIMITED TO ONE HUNDRED DOLLARS, OR THE FEES YOU PAID VIRIDIAN FOR USE OF THE MARKETPLACE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. FOR A CLAIM ABOUT AN ITEM VIRIDIAN SOLD YOU, THE LIMIT IS ONE HUNDRED DOLLARS OR THE PRICE YOU PAID FOR THAT ITEM, WHICHEVER IS GREATER.
Nothing in these terms limits liability that cannot be limited by law.
16. Your responsibility to Viridian
If you submit a listing or materially breach these terms, you agree, to the extent permitted by law, to defend, indemnify and hold harmless Viridian, its officers, employees and agents from third-party claims, damages, judgments, settlements and reasonable legal fees arising from your listing content, your rights to the item, your transaction, your unlawful conduct or your breach. Viridian will provide reasonably prompt notice of a claim and reasonable cooperation.
17. Changes
We may change the Marketplace or these terms. If we change these terms, we will post the new version with its effective date. We will tell sellers by email of any significant change, and sellers will be asked to accept the new terms before submitting or renewing a listing. A change applies from its effective date and does not apply to a dispute that arose before that date.
18. Law and disputes
These terms are governed by the laws of the State of Washington. Any dispute about the Marketplace or these terms will be decided in the state or federal courts located in King County, Washington, and you agree to those courts' authority, unless the law where you live gives you the right to bring a claim in your local courts.
19. General
- Whole agreement. These terms govern use of the Marketplace. Specific terms supplied for a sale by Viridian also apply to that transaction.
- Independent parties. Nothing in these terms makes Viridian your agent, partner, employer or joint venturer, or makes any seller or store Viridian's agent.
- Notices. You agree that we may send you notices by email to the address on your account, or by posting them on the Marketplace. You may send notices to us at the email or postal address in section 20.
- Transfer. You may not transfer your rights under these terms. Viridian may transfer its rights and obligations to an affiliate or to a successor that operates the Marketplace.
- Survival. Provisions concerning content rights, disputes, warranties, liability, indemnification and governing law survive as applicable after use ends.
- Severability and waiver. If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term right away, we may still enforce it later.
- Headings. Headings are for convenience only.
